Terms of Service

1. Who we are

“Jean Phil Video”, “we”, “us”, and “the Service” refer to this independently operated AI video tool. It lets you work from a reference scene, upload your own video and character photos, or describe a video idea. “You” refers to the person or entity using the Service. The Service is not presented as an official product of the creators or rights holders of Jean Phil or any other referenced character.

2. Accounts

You sign in with your email address via a one-time magic link, or with a Google account. You are responsible for keeping access to your email or Google account secure, and for all activity under your account. You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service.

3. Credits and billing

Video generation uses credits. The server calculates the estimate from the selected quality and duration; for uploaded video, the final charge is based on verified media. Review the estimate and settings before submitting. Promotional credits, where offered, are subject to eligibility and abuse-prevention checks and may not cover a video generation.

• Credit packs are one-time purchases. Purchased pack credits do not expire while your account remains active; credits have no cash value and cannot be transferred.
• The Service checks your balance before uploading references. This is a preliminary check, not a reservation or a guarantee that a later submission will succeed. It checks again and reserves credits atomically when a valid generation task is created.
• Credits are settled after the generated output has been validated and privately archived. Confirmed rejection or failure releases the reserved credits once. If submission or processing is uncertain, credits may remain reserved while the existing task is reconciled; do not submit duplicate jobs to resolve an uncertain status.
• Payments are processed by Stripe. We do not store your full card details. Current pack prices and credit amounts are displayed before purchase.
• Where an existing account has a subscription, its monthly allowance resets each billing cycle and does not roll over. You can manage or cancel it from billing; cancellation stops future renewals.

Returning reserved generation credits is not a refund of a credit-pack purchase. Purchase refunds and mandatory consumer rights are addressed in our Refund Policy; nothing in these terms excludes rights that cannot lawfully be excluded.

4. Acceptable use

You agree not to use the Service to create, upload, or distribute content that:

• is unlawful, infringes intellectual property, music, image, likeness, or privacy rights, or uses another person’s face or voice without the necessary permission;
• depicts sexual content involving minors or non-consensual intimate imagery;
• is intended to harass, defame, defraud, or deceptively impersonate others, including through misleading deepfakes;
• promotes violence, self-harm, or illegal activity; or
• attempts to reverse-engineer, overload, scrape, or circumvent the Service’s limits or security.

You must have permission for the people, footage, music, and other materials in your uploads. Access to a reference scene on this site does not by itself grant commercial rights to its characters, performance, or audio. We and our providers may reject prohibited content, remove content, or suspend or terminate accounts that violate these terms.

5. Your content and ownership

You retain the rights you already hold in your inputs. You must have the rights and permissions needed to upload them and to use the outputs, including any required permission from identifiable people. Any rights you may hold in generated content depend on applicable law and third-party rights; we do not promise copyright protection, exclusivity, or clearance for commercial use.

You grant us the limited rights needed to process, store, and transmit your inputs and outputs to provide the Service, including delivery to processing providers and private storage. We do not train our own AI models on your content. Providers process content under their own terms and policies; see our Privacy Policy for the data flow and retention details.

6. AI-generated output

AI output may be inaccurate, inconsistent, or similar to other outputs. A face or character replacement may change expressions, clothing, motion, or other people in a scene; reference footage does not guarantee an identical result. Provider moderation may reject a request. No particular likeness, audio track, turnaround time, or commercial suitability is guaranteed. Review outputs and any applicable disclosure requirements before publishing.

7. Third-party services

The Service uses fal.ai for generation, Cloudflare R2 for private media storage, Inngest for durable workflows, Stripe for payments, Resend for email, and Google for optional sign-in and configured analytics. Vercel Analytics is also integrated. These services can impose their own availability limits and content rules. See our Privacy Policy for how data is shared and retained.

8. Disclaimers and liability

The Service is provided “as is” without warranties of any kind, to the fullest extent permitted by law. To the maximum extent permitted by law, our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the three months before the claim, or USD $100. We are not liable for indirect, incidental, or consequential damages.

9. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these terms or if required by law. On termination, unused credits are forfeited except where the law requires otherwise.

10. Changes to these terms

We may update these terms from time to time. If we make material changes, we will update the “last updated” date and, where appropriate, notify you. Continued use after changes take effect means you accept the revised terms.

11. Governing law

These terms are governed by the laws of the jurisdiction in which the Service operator is established, without regard to its conflict-of-laws rules. Any disputes will be subject to the courts of competent jurisdiction, except where mandatory local law provides otherwise.
